Under New York RICO statutes, a person can be charged with having been a part of a criminal enterprise when he was employed or associated with such an enterprise, despite his knowing the nature of the of its criminality.

He can be considered culpable if he:

• Intentionally participates in the affairs of a criminal enterprise
• Intentionally maintains an interest in a criminal enterprise or acquires such an interest
• Intentionally invests in a criminal enterprise

The law considers a criminal enterprise to be any continuous group of people who together engage in criminal conduct, who have a defined structure to their association, and whose criminal activity goes beyond a simple aggregation of individual criminal acts.
